Washington State Legislature – Motorcycle Rider Legislative Update

 

 

The following is a list of legislation of interest to motorcycle riders that is currently pending before the Washington State Legislature.  This list is provided as a way for our readers to stay informed and to enable you to contact legislators as they debate issues and for you add your own personal input.

Major news:    Governor signed the Profile Bill, SB 5242.   Helmets in Parades HB 1328 has passed and is waiting for the Governor to sign.

 

HB 1098         Traffic Safety Cameras --  Requires a vote of the people before installing traffic cameras, increases yellow light duration, and prohibits using citations as points on records or for license review by employer or insurance companies.

 

                        Assigned to the House Transportation Committee  DEAD FOR THE SESSION

 

HB 1099         Automatic Traffic Cameras --  Also requires a vote of the people before installing traffic cameras, increases yellow light duration, and prohibits using citations as points on records for license review by employer or insurance companies.  Prohibits compensation to company owning cameras based on fine revenue.

 

                        Assigned to House Transportation Committee   DEAD FOR THE SESSION

 

HB 1328         Motorcycle Helmet in Parades --  Allows a local police chief (rather than the State Patrol) to temporarily suspend helmet requirement for local parades.  (Same as SB 5185)

 

                        Passed both houses – waiting action by the Governor

 

HB 1333         Profiling – Prohibits law enforcement officers from profiling motorcycle riders and using factors such as clothing worn or motorcycle paraphernalia in deciding whether or not to stop a rider or take action or search or arrest a person without lawful justification.  (Same as SB 5242)

 

                        In House Rules committee waiting for debate by the full House  DEAD FOR THE SESSION (Senate bill still active)

 

HB 1527         Motorcycle Traffic Signals – Allows a motorcyclist to proceed through traffic control signals when the sensor fails to recognize the bike to activate the signal and after one cycle of the light.

 

                        Assigned to the House Transportation Committee    DEAD FOR THE SESSION

 

HB 1533         Off Road Motorcycles – Allows off-road motorcycles to ride short distances on certain roads in order to reach an off-road area.

 

                        Assigned to House Transportation Committee  DEAD FOR THE SESSION

 

HB 1542         Motorcycle Theft Tools – Makes possession of tools designed to be used to steal a motorcycle as a crime. 

 

                        Pass the House – Assigned to Senate Judiciary Committee  DEAD FOR THE SESSION

 

HB 1543         Motorcycle Instruction Permits – Limits an unendorsed rider to three instruction permits, and the third is issued only when the rider shows proof of enrolment in a certified motorcycle instruction class.  (Same as SB 5141)

 

                        Passed the Senate Transportation Committee – DEAD FOR THE SESSION

 

HB 1590         Traffic Safety Cameras – Similar to HB 1098 and HB 1099 but also requires a referendum be submitted to voters on retention of existing cameras.

 

                        Assigned to House Transportation Committee  DEAD FOR THE SESSION

 

SSB 5027        Requiring motorcycle manufacturers to indicate off-road only – Requires that manufacturers to indicate whether a motorcycle is intended for off road use only.

 

                        Passed Senate Transportation Committee – pending before the full Senate – DEAD FOR THE SESSION

 

SSB 5063        Motorcycle Special Plates – Allows motorcycles to apply for and get certain specialty plates (such as armed services and purple heart medal) that under law now are limited only to cars.

 

                        Amended and passed the Senate Transportation Committee – now pending before the full Senate  DEAD FOR THE SESSION

 

SB 5141          Motorcycle Instruction Permits – Limits an unendorsed rider to three instruction permits, and the third is issued only when the rider shows proof of enrolment in a certified motorcycle instruction class.  (Same as HB 1543)

 

                        Passed the both Houses – pending action by the Governor

 

SSSB 5185      Motorcycle Rules Parades – Eliminates the requirement that the State Patrol be allowed to suspend helmet requirements for parades and allows parade participants to ride without a helmet.  Amended to state that the parade must be on a closed road and permitted by a local jurisdiction.  (Same as HB 1328)

 

                        Passed the House Transportation Committee – Identical House bill passed and waiting for action by the Governor

 

SSB 5242        Profiling – Prohibits law enforcement officers from profiling motorcycle riders and using factors such as clothing worn or motorcycle paraphernalia in deciding whether or not to stop a rider or take action or search or arrest a person without lawful justification.  (Same as HB 1333)

 

                        Signed by the Governor – will be effective 90 days after the session ends
